Privacy Policy

This Privacy Policy explains how we handle personal data that we process as a data controller (including visitors to our website and contacts of (prospective) clients). When we process personal data on behalf of a client as part of our software, we act as a processor and our separate Data Processing Agreement applies.

2. What personal data do we collect?

We use the collected information for various purposes, including:

  • Contact details: name, email address, phone number, company name.

  • Communications: the content of emails, messages and conversation notes.

  • Website data: technical data such as IP address and browsing behaviour (via cookies, see section 9).

3. Purposes and legal bases

Contacting you and preparing quotes → pre-contractual measures / legitimate interest

  • Performing the agreement and invoicing → performance of the contract / legal obligation

  • Commercial communication to business contacts → legitimate interest (with the right to object)

  • Improving our website and services → legitimate interest

4. Retention periods

Client data is retained for as long as the client relationship is active, and thereafter for the legally required periods (e.g.
invoicing and accounting records: 7 years).

  • Data of prospects/contacts is retained for as long as there is a reasonable commercial interest, and deleted on request.

5. Sharing with third parties

We do not sell personal data. We only share data with service providers (processors) who help us deliver our services, such as hosting, email and AI providers, and with authorities where legally required. We enter into data processing agreements with these processors.

6. International transfers

Certain service providers (in particular AI providers such as Anthropic and OpenAI) process data outside the European Economic Area (United States). This takes place on the basis of appropriate safeguards, in particular the European Commission's Standard Contractual Clauses (SCCs). Primary storage takes place within the EEA.

7. Security

We take appropriate technical and organisational measures to protect personal data, including encryption, access control and logical separation of data.

8. Your rights

You have the right to access, rectification, erasure, restriction, data portability, and to object to the processing of your personal data. Requests can be sent to mail@elysium-suite.com.
